Terms of Use

These terms govern your use of the iOS and Android app "SUIKEI" and its related website (the "Service"), provided by Verdo Lab ("we", "us"). By using the Service you are taken to have agreed to these terms. 日本語

1. Scope and what the Service is

The Service lets you record and look back on photos of your aquarium, water parameters and care activities. It does not give advice or diagnosis about husbandry, whether your water is healthy, or the condition of your livestock.

2. Your account

1. You are responsible for your own account and must not let anyone else use it.
2. Once you delete your account, your content and photos cannot be recovered.
3. We are not liable for loss arising from inadequate management of your account or its use by a third party, except where we have acted with intent or gross negligence.

3. Age and minors

The Service is intended for people aged 18 and over. If a minor uses the Service or purchases a paid plan, they must do so with the consent of a parent or legal guardian.

4. SUIKEI Premium

1. An auto-renewing subscription at JPY 480 per month or JPY 4,800 per year (tax included). The current price for your region is shown on the purchase screen.
2. All features are free for 45 days from the day you add your first tank. After that the app switches to the free plan: you can keep adding and editing photos, care logs and readings for one tank, and viewing, exporting and deleting stay available. Additional tanks, comparing any two days, full-length time-lapse export and cloud backup are paid features.
3. Payment is taken through the App Store or Google Play.
4. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Cancel from the subscription settings of the relevant store.
5. Refunds are governed by the policies of the relevant store.

5. Your content

1. You keep all rights in the photos, text and other content you add.
2. We store, transmit and process it only as far as needed to provide, maintain and improve the Service.
3. You may only add content you have the lawful right to use.

6. What you must not do

• Anything unlawful, contrary to public order and morals, or infringing the rights of others
• Unauthorised access, placing excessive load on the Service, or interfering with its operation
• Decompiling, disassembling or otherwise reverse engineering the Service
• Copying, modifying, redistributing, reselling or lending the Service without permission
• Anything else we reasonably consider inappropriate

7. Suspension

If you breach these terms, register false information or otherwise use the Service improperly, we may suspend your use or delete your account without prior notice.

8. Changes, interruption and discontinuation

We may interrupt the Service for maintenance, faults, force majeure and similar reasons. If we discontinue the Service we will normally give at least 30 days' notice in the app or on the website.

9. No warranty

1. The Service is provided as is. We do not warrant its accuracy, completeness or continuity.
2. Water parameter guidance and reminders are aids to your own management. They do not guarantee the health or survival of your livestock, the growth of your plants, or the safety of your equipment. For specialist husbandry decisions, consult a specialist retailer, a veterinarian or another qualified professional.
3. Please back up important records using the export function.

10. Limitation of liability

Where we are liable, and except in cases of intent or gross negligence, our liability is limited to direct and ordinary loss actually incurred, up to the total fees you paid in the preceding 12 months (or JPY 5,000 if you used the Service free of charge). Nothing in these terms limits liability that cannot be limited under mandatory law, including consumer protection legislation.

11. Changes to these terms

We may amend these terms in accordance with Article 548-4 of the Japanese Civil Code. We will announce the changes and their effective date in the app or on the website a reasonable time in advance.

12. Governing law and jurisdiction

These terms are governed by the laws of Japan, and the Tokyo District Court shall have exclusive jurisdiction as the court of first instance for disputes relating to the Service.

This clause does not deprive you, as a consumer, of the protection given to you by mandatory provisions of the law of your country of residence. If you live outside Japan you may be able to rely on rights available to you under local law.
